These Terms of Use set out the conditions for using the app ShuMag (the "App"), provided by Delial.design ("we," "us," or "our"). By using the App, you ("User") agree to these Terms.
These Terms are an English translation of the original Japanese Terms. If there is any difference between the two, the Japanese version prevails.
Article 1 (Scope)
These Terms apply to all matters between us and Users relating to the use of the App.
Article 2 (Accounts)
- Users must register accurate information.
- Users are responsible for managing their accounts. We are not responsible for any unauthorized use by third parties.
- Children may use the App only under the responsibility of a parent or guardian.
- If a User deletes their account, all registered data will be deleted and cannot be restored.
Article 3 (Fees and Subscriptions)
- The App offers a free plan and paid plans (subscriptions).
- Paid plans are billed through the Apple App Store. Prices are as shown on the App Store.
- Subscriptions renew automatically unless canceled at least 24 hours before the renewal date. You can cancel from the subscription settings of the App Store.
- Fees already paid are not refundable, except where required by law.
Article 4 (Prohibited Conduct)
When using the App, Users must not:
- Act in violation of laws or public order and morals
- Infringe the copyrights, property, privacy, or other rights of us or any third party
- Misuse the App, access it without authorization, or reverse engineer it
- Cause disadvantage or damage to other Users or third parties
- Interfere with the operation of the App
- Engage in any other conduct we consider inappropriate
Article 5 (Intellectual Property)
- Copyrights and other intellectual property rights in the App and its content (including programs, designs, text, and logos) belong to us or the rightful owners.
- Rights to the data Users register in the App belong to the Users. We handle this data only to the extent needed to provide and improve the App.
Article 6 (Changes, Suspension, and Termination of the Service)
We may change, add to, suspend, or end the App without prior notice to Users. We are not responsible for any damage this causes to Users.
Article 7 (Disclaimer)
- We do not guarantee that the App is complete, accurate, useful, or free of defects.
- We are not responsible for any damage arising from the use of or inability to use the App (including loss of data), except in cases of our willful misconduct or gross negligence.
- We are not responsible for any disputes between Users or with third parties.
- Notifications may not work depending on the state of your device or OS, and we do not guarantee that they will be delivered.
Article 8 (Changes to These Terms)
We may change these Terms when we consider it necessary, by notifying Users. If you use the App after the change, you are deemed to have agreed to the changed Terms.
Article 9 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan. Any dispute between us and a User relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location.
